By creating an account or using Kinetic, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you must not use the service.

2. Service Description

Kinetic is an AI-powered motion graphics generator that converts natural language prompts into animated video compositions. The service includes content generation, video export, project management, and related features as described on our website.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years of age to use the service.
• One person or entity may not maintain more than one account.

4. Subscriptions and Payments

Kinetic offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with applicable law.

5. Intellectual Property

• Your Content: You retain ownership of the prompts you provide and the motion graphics you create using Kinetic.
• Our Service: Kinetic, including its software, design, and documentation, is the intellectual property of Nativemind and is protected by applicable laws.
• License: We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose during your subscription.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Generate content that is harmful, abusive, or infringes on third-party rights.
• Attempt to reverse-engineer, decompile, or extract the source code of the service.
• Interfere with or disrupt the service or its infrastructure.
• Resell or redistribute the service without authorization.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Nativemind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

We may suspend or terminate your access to the service at our discretion if you violate these Terms. Upon termination, your right to use the service ceases immediately. You may request export of your data prior to account deletion.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the Republic of Korea.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Continued use of the service after such changes constitutes acceptance of the revised Terms.
